<span style="font-size: 150%">Hello $playerName,</span>
My name is Erica, and I am the copyright lead at Coventry University Online.
I designed this resource to help you choose how to license your work to maximise the impact of your creations while keeping the kudos associated with your work.
Feel free to explore and share this resource.

<span style="font-size: 70%">This material is not intended to be legal advice. In doubt, seek professional assistance.

<span style="font-size: 90%">"Licensing your work" was created by Erica Levi. © Coventry University. (2023). Great! It is important that you state that you have created the work and that you let others know how they can use your work.
Since you have no limitations on third party material in your work, you may now choose how you wish to license your material.
You may add any acknowledgements by stating that you have created your material and you own the copyright.
<span style="font-size: 85%">It will be helpful to state the year - this will inform future users and enable them to cite your resource and demonstrate academic rigour.</span>
This would be something like:

If you want to acknowledge collaborators who did not co-author with you, you may add the following:
|Quote>[The author(s) thank(s) //name(s)// for their help/support/advice/contribution.]
[[Choose how you wish to release your material.->Choose how you wish to release your material]]Sometimes, there are specific limitations on how to release your material to the public, and you need to familiarise yourself with any guidance.

Ok, $playerName, your resource is all your work, and it doesn't include any third-party material.
You can go ahead, but who owns your work before we do?
//Some people create work as part of an agreement; this may be under a contract of employment, work for hire or even as a separate arrangement, such as, for example, part of students' enrolment conditions. You need to familiarise yourself with the details that apply to you and your particular resource.//
<span style="font-size: 120%">$playerName, who owns your work?</span>
[[I own the work I create.->I own the work I create]]
[[Somebody else owns the work I create.->Somebody else owns the work I create]]
$playerName, you should check any licence limitations on the material you have reused.
|box>[As much as you cannot lend or sell somebody else's car without its owner's permission, you cannot distribute material owned by a third party without their licence.]
In some instances, and if the licence allows it, you may create an adaptation, meaning creating a new version with considerable changes in the material you have reused, and you need to acknowledge it as an adaptation from the original. //The changes must be quite considerable//, so just swapping a colour or increasing the lines' thickness won't be sufficient - it must be quite different.
Adaptations and reuses tend to be quite a treacherous part of copyright law, and you should seek advice.
Best practice depends on the media you use (music, video, text, images, or maps), the context (instruction or sale) and the geographical jurisdiction where you create and distribute your material.
In some countries, the reuse of copyright material without permission from the copyright holder is permitted under specific conditions. In the United Kindgom, the law permits certain statutory copyright exceptions. You can read more about them on the government's <a href="https://www.gov.uk/government/publications/changes-to-copyright-law="_blank">website</a>.
Even if you include material licensed under the Creative Commons licences, there is guidance that you must follow to ensure you respect the terms of the licence of the material you wish to reuse.

Alternatively, $playerName, would you like to explore the other scenario?
[[Let me check my options if I had not included other people's material.->No, the resource is all my work]]Great!
As you have no third party material in your resource, you may choose how you wish to license it.
[[Go ahead, $playerName.->Choose how you wish to release your material]]The most important point to remember is the purpose of your resource and how widely you wish it to be known and used.
This will help to inform your choice of the licence you wish to assign to your material.
$playerName, which one of the following statements applies to you?
[[I do not wish people to use the material without my explicit permission.->I do not wish people to use the material without my explicit permission]]
[[I wish people to use my material, but I want to be acknowledged as the original creator.->CC]]

You dedicate your material to the public domain, so anybody can use it without acknowledging or stating that you have created it. You are forgoing your copyright on the material.

[[Choose again how you wish people to use your material.->Choose how you wish to release your material]]
[[Go back to the beginning to explore more of this resource.->Home]]
[[I will leave it here, thank you.->Last passage]]You have chosen to mark your material as "All rights reserved", the most restrictive option.
You assert that all rights are reserved, and you wish to stop people from using the material without your explicit consent.
|Box>[Some countries' copyright laws will still allow certain uses, for example, as an exception for education; otherwise, people will have to check with you.]
//The statement you need to add to assist potential users is://
|Quote>[© //author(s)//. (//year//). All rights reserved.]
//For example://
|Example>[© Erica Levi. (2023). All rights reserved.]
//Or simply://
|Example>[© Erica Levi. (2023).]
It would help potential users if you were to add how they may contact you on the resource to seek your permission.
|box>[It is important to consider this choice's effect on your resource. Users may be able to access it if they can find it online. Still, they cannot redistribute the resource and include it in their work unless your intellectual property is actively managed by a publisher or yourself.]
`“`All rights reserved`”` could be valuable if you intend to have a commercial advantage on your material. Suppose this is not feasible for the very nature of your resource; in that case, you may wish to consider open licences that, at the very least, will allow your material to be freely circulated and used by others.
Do you wish to look at other options? An open licence may be more useful and less bothersome.
[[Have another go and choose again how you wish to use your material.->Choose how you wish to release your material]]
[[I will leave it here, thank you.->Last passage]]<img src="https://ericalevi.coventry.domains/assets/by.png"; alt="A graphic of a man inside a circle"; height="100" width="100" style="display: block; margin-right: auto; margin-left: auto;"><center>**The By Attribution element of the Creative Commons Licences**</center>
You can release your resource with one of the open licences to ensure people can re-use your work whilst acknowledging you as the original creator. Open licences were created in response to the Internet's development that empowered people to create and freely share and publish material online. The traditional copyright system became ill-suited to the new way of freeing the circulation of knowledge.
The most renowned open licences are the Creative Commons. //They are all based on the principle of granting permission for people to reuse material in advance//. In other words, the copyright owner grants a licence to reuse material from the point of creation or publication of their original material.
**Open licences facilitate the circulation of information and empower the advancement of knowledge and the progress of humankind.**
There are six Creative Commons licences. They all have in common the requirement that the original creator or copyright owner must be acknowledged.
**You must ensure the visibility of your name against your material; otherwise, a user will be unable to acknowledge you as the creator of the original creation.**
$playerName, what do you think about assigning an open licence to your material?
[[I don't like it at all, I wish to choose another option.->Choose how you wish to release your material]]
I like the sound of this, though...
[[I do not want to allow people to distribute adaptations of my material.->ND]]
[[I really don't mind.->I want to allow adaptations of the material I am sharing]]<img src="https://ericalevi.coventry.domains/assets/nd.png"; alt="A graphic of an "=" inside a circle"; style ="display: block; margin-right: auto; margin-left: auto;"><center>**The NonDerivatives element of the Creative Commons Licences**</center>
You choose this option when you wish your work to be shared in its integrity. This is useful when you want to publish important information or concepts you do not want altered or diluted.
The NonDerivatives element of the Creative Commons licences is quite restrictive and using it will make your resource not genuinely open access. This is important to consider when you must fulfil certain open access requirements from funders or publishing platforms.
It also means that users cannot take parts of your material and adapt them for a different or similar purpose, build upon it and create a new resource altogether.
Now you need to decide whether...
[[You do not wish users to commercially exploit your material.->CC-BY-NC-ND]]
Or...
[[You do not mind.->CC-BY-ND]]
$playerName, by choosing this option, you are happy for people to build upon your material as long as you are acknowledged as the creator or copyright owner.
Your next decision is whether...
[[You want to force users to share their new material with the same licence.->SA]]
Or...
{[You don't really mind.->I do not mind if people choose another licence for their new material]]<img src="https://ericalevi.coventry.domains/assets/sa.png" height="100" width="100" style="display: block; margin-right: auto; margin-left: auto;"><center>**The Share-Alike element of the Creative Commons Licences**</center>
You are, therefore, choosing the Share-Alike element of the Creative Commons licences.
You are happy for people to build upon your material and share it as long as they acknowledge you as the original creator/owner and as long as they share their new creation as you did, with the same licence, without adding any new Creative Commons elements.
$playerName, your next step is to chooe one of the following options:
[[I do not wish to allow commercial exploitation of my work.->CC-BY-NC-SA]]
[[I don't mind if people commercially exploit my work.->CC-BY-SA]]You are happy for people to build upon your material and share it as long as they acknowledge you as the original creator/owner. You are happy people can add or remove Creative Commons elements of their new material based on your work.

You have chosen the Creative Commons licence By Attribution NonCommercial Share-Alike.
You are happy for people to include your material in other resources or build upon it, but you do not wish them to sell their material. You stipulate that they should acknowledge you as an owner or creator and apply for the same licence as you originally did.
|box>[<div>**Why would you want your resource to be licenced in the same way?**

|box>[<div>**Why would you choose to allow people to make commercial use of your work?**
At times, it is irrelevant whether you can profit from your creation. You might not even have a system that will allow you to be discovered and contacted to sell your work. [[I am creating a collection of Creative Commons Licensed resources.->Collection]]|Quote>[**What is an adaptation?** Making an adaptation means creating a new version of the original with considerable changes. You need to acknowledge the original and the changes you have made].
Changes must be quite considerable, so just swapping a colour or increasing the lines' thickness won't be sufficient - it must be different.
|box>[Let's think of broccoli. You take a raw cluster, wash it, cut it into smaller florets and flavour it while you cook it. You have made substantial changes to the original.]
You must consider the licences' compatibility when creating new material by adapting or changing a pre-existing Creative Commons licensed material.
Adapting "All rights reserved" copyrighted work may be tricky, and the law is open to interpretations.
Where material has been licensed under the Creative Commons, permitted uses are easier to understand. Nevertheless, even some Creative Commons licences will not allow you to create adaptations; the following chart is a guide to ensure that your derived work complies with the licences' terms.
<img src="https://ericalevi.coventry.domains/assets/adapting.png"; alt="The table is titled "Adapter's licence chart" and details the compatibility of different licences for adapting works based on their original licence. The intersections of these rows and columns are colour-coded to indicate compatibility: green cells represent permissible combinations, yellow cells represent permissible combinations with some restrictions, and grey cells represent combinations that are not allowed. The left-hand column identifies the licence of the original work to use in the adaptation. By looking across the table, it shows the available licences for the new creation.
Examples:
* If one adapts a By Attribution NonCommercial (BY-NC) work, the BY-NC will do for the adaptation.
* If one adapts a By Attribution (BY) work, either BY or BY-NC will do for to the adaptation.
* Work licensed with BY-SA or BY-NC-SA; the same licence must be applied for the adaptation.
* Work that was created under one of the NoDerivs (ND) licences cannot be adapted, not even for personal use only, unless the ND licences in marked version 4.0.

[[I will leave it here, thank you.->Last passage]]Remixing "All rights reserved" copyrighted work may be tricky, and the law is open to interpretations.
Where material has been licensed under the Creative Commons, permitted uses are easier to understand. A type of licence compatibility relates to licences when **remixing** more than one pre-existing work.
Mixing and adapting are conceptually different.
|Box>[Think of a smoothie; you mix fruit from different sources to create a wholly new creation.] Look at the table below, find on the left column a licence of the works and match it with the one on the top to discover a licence that may apply to a second work:

The leftmost column lists different types of Creative Commons licenses, and the top row lists the same licenses. The intersections of these rows and columns indicate whether a specific combination of licenses is compatible, where each cell in the grid either has a checkmark (signifying that the combination of licenses is compatible) or a black "X (indicating that the combination of licenses is incompatible). In particular, Public Domain and CC BY (Attribution) are compatible with all but those with a NoDerivs element; CC BY-SA (Attribution-ShareAlike) is compatible with all but those with NonCommercial and NoDerivs elements; CC BY-NC (Attribution-NonCommercial) and CC BY-NC-SA (Attribution-NonCommercial-ShareAlike) are compatible with all but CC BY-SA (Attribution-ShareAlike) and those with a NoDerivs element; CC BY-ND Attribution-NoDerivs and CC BY-NC-ND Attribution-NonCommercial-NoDerivs are incompatible with any.">

A ‘tick’ at the intersection means that works under those two licences can be remixed.
An ‘X’ means that normally the works may not be remixed.

[[I will leave it here, thank you.->Last passage]]A **collection** is the assembly of separate and independent creative works into a collective whole work. It compiles different materials together while keeping them organised as distinct, separate objects. A collection is not an adaptation because any original material remains unchanged.
Creating collections of "All rights reserved" copyrighted work may be quite tricky, and the law is open to interpretations.
Where material has been licensed under the Creative Commons, permitted uses are easier to understand.
When you combine Creative Commons licensed material into a collection, you must provide attribution and licensing information about the individual works in your collection and you may have a separate copyright of your own that you may license, for example for the introduction, commentary, and so forth.
An example of a collection could be a selection and arrangement of pre-existing poems published by others into an anthology, writing an introduction, and designing a cover for the collection. Still, your copyright and the only copyright you can license extends to your arrangement of the poems (not the poems themselves), and your original introduction and cover. The poems are not yours to license.
